The FIR in connection with which the petitioner was arrested was lodged on 06.03.2026 by the police personnel of Kamakhya, GRP Police Post stating inter alia that on information that some persons are involved in transporting fake currency notes, the informant along with others conducted checking of the passengers luggage bags at Kamakhya Railway Station and that during the checking, they found a person at a particular platform who was found moving in suspicious manner and on checking the bag that he was carrying, the informant and others found many bundles of fake currency notes amounting to total of Rs. 4,23,500/-

The learned Counsel for the petitioner submits that on conclusion of the investigation, the police submitted charge sheet against the petitioner and the charges were framed against the petitioner and during the trial, two of the witnesses out of the 10 witnesses were examined. He submits that the petitioner has been inside the jail since 06.03.2026 and that the trial will take long and on the ground of long incarceration, the petitioner be released on bail. 4. Mr. RJ Baruah, learned Additional Public Prosecutor for the State, on perusal of the case records submits that eight more witnesses are yet to be examined and that the petitioner should not be enlarged on bail since there is every possibility that he will influence the witnesses. He further submits that fake notes were found in the possession of the petitioner and the same were recovered from him. 5.
Upon consideration of the submissions made by the learned Counsel for the parties, more so, in view of the fact that the trial is on and the petitioner is incarcerated for the last more than six months and also that the petitioner is required to prepare his case for his defence, this Court deems it fit to enlarge the petitioner on bail on furnishing of bail bond of Rs. 20,000/- with two local
Page No.# 3/3 sureties of the like amount to the satisfaction of Session Judge, Kamrup(M) under the following conditions:
i) the petitioner will appear before the Trial Court as and when called for. ii) the petitioner will not hamper, tamper with the evidence, neither influence the witnesses connected with the case. iii) the petitioner will not leave the place of residence in Guwahati without the permission of the Sessions Judge. 6.
