Heard Mr. L.R. Mazumder, learned counsel for the petitioner. Also heard Mr. R.R. Gogoi, learned counsel appearing on behalf of Mr. D. Gogoi, learned standing counsel for the respondent-Forest Department. 2. In this petition, under Section 528 of the BNSS, 2023, the petitioner has prayed for setting aside and quashing the order dated 20.08.2026, passed by the learned Sub-Divisional Judicial Magistrate(M), Bilasipara (‘trial Court’, for short), in C.R. Case No. 43/2024, whereby Non-Bailable Warrant of Arrest
Page No.# 2/2 (NBWA) was issued against the petitioner as he failed to appear before the learned trial Court despite issuance of Bailable Warrant of Arrest against him. 3. Mr. Mazumder, learned counsel for the petitioner submits that the petitioner is an accused in C.R. Case No. 43/2024 and that earlier, he approached this Court by filing one criminal petition for quashing the entire proceeding of C.R. Case No. 43/2024, but subsequently, he had withdrawn the same. Mr. Mazumder also submits that the petitioner is willing to face the trial and that he will appear before the learned trial Court on each and every date, and under such circumstances, he has contended to afford an opportunity to the petitioner to appear before the learned trial Court and also to face the trial. 4. Mr. R.R. Gogoi, learned counsel appearing on behalf of Mr. D. Gogoi, learned standing counsel for the respondent-Forest Department submits that the petitioner may be directed to appear before the learned trial Court. 5. Taking note of the submissions of learned counsel for both the parties, this Court is inclined to allow the petition. Accordingly, the petitioner, namely, Sanjit Das @ Bachu is directed to appear before the learned trial Court on or before the next date fixed i.e. 04.11.2026 and apply for regular bail, and in the event of filing such an application, the learned trial Court shall consider the same in accordance with law. 6.
Till then, the NBWA issued against the petitioner shall be kept in abeyance. 7. In terms of above, this petition stands disposed of. JUDGE Comparing Assistant
