By way of this application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the applicant seeks regular bail in connection with Case No. 159/2026, arising out of Crime No. DRI/DZU/34/Enq-34/2025, registered under Sections 20(b)(ii)(c) and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985. 2. The applicant had last applied for regular bail before this Court less than a month ago by way of BAIL APPLN. 2938/2026, which was dismissed as withdrawn vide order dated 27.07.2026, with the following observations: “2. It is the applicant’s case that he has been wrongly prosecuted under Sections 20(b)(ii)(c) and 29 of the NDPS Act on the basis of the alleged clubbing of the recoveries purportedly effected from him and the co-accused – Iram Salim Khan. Mr. Javed Khan, learned counsel for the applicant, however, submits that this contention shall also be This is a digitally signed order. After some hearing, Mr. Javed Khan, learned counsel for the applicant, seeks permission to withdraw the present bail application, without prejudice to the applicant’s rights and remedies available in law before the learned Special Court, including the right to seek bail afresh, if so advised, after the framing of charge.” 3. In the present case, even though the arguments on charge have not yet been heard by the Special Court, the applicant has filed this application before this Court. The applicant has also not approached the Special Court again. 4. The only ground urged by Mr. Javed Khan, learned counsel for the applicant, is that on the last date of hearing before the Special Court, i.e. 30.07.2026, an adjournment was granted at the request of co-accused - Iram Salim Khan. 5. Having regard to the observations in the order of this Court dated 27.07.2026, Mr. Khan seeks permission to withdraw this bail application. 6.
