This revisional application seeks expeditious disposal of Title Suit No.377 of 2008 pending before the learned Civil Judge (Senior Division), 1st Court at Hooghly. 2. Learned advocate appearing for the petitioner submits that in the said suit upon the preliminary decree being passed, a Partition Commissioner was appointed as far as back on January 13, 2016 but the said Partition Commissioner has not yet filed the report despite the fees as directed by the Court having been paid to the Commissioner. 3. In view of the nature of the order proposed to be passed, prior service of the revisional application along with a notice is not being directed, however, the petitioner shall remain obliged to serve a copy of the revisional application along with a copy of this order upon the opposite party within a week from date. 4. Having heard the learned advocate appearing for the petitioners and having considered the material on record, this revisional application is disposed of by requesting the learned Trial Court to pass appropriate orders so as to ensure filing of the report by the Partition Commissioner in terms of the direction passed by the learned Court on January 13, 2016 expeditiously and to dispose of Title Suit No.377 of 2008 as expeditiously as possible and preferably within a period of six months from the next date fixed without granting any unnecessary adjournment to either of the parties. 5. The parties shall be free to make appropriate application for removal of the partition Commissioner in case of any further delay on his part and in such case the Partition Commissioner may be directed to refund the amount paid to him by the parties towards his remuneration. 6. With the aforesaid observations, CO 549 of 2026 stands disposed of. No costs. 7. Urgent certified photocopy of this order, if applied for, be supplied as expeditiously as possible.
