2. This is an application under Section 483 of BNSS, 2023 praying for regular bail to the petitioners namely (1) Tafajul Islam and (2) Achadul Islam, who were arrested on 29.06.2026 in connection with NDPS Case No. 48/2026
Page No.# 2/2 (Corresponding to Mikirbheta P.S. Case No. 89/2026) registered under Sections 21(b)/ 29 of the NDPS Act, 1985.
3. As per the FIR, 7.94 grams of suspected heroin was recovered from the possession of the petitioners.
4. The learned counsel for the petitioners submitted that the aforesaid quantity of suspected heroin would come into the category of intermediate quantity and recovery was made from the house of the petitioner No. 2 Achadul Islam.
5. The scanned copy of the TCR including the case diary is received and perused. The petitioners have spent 87 days in the custody so far.
6. Having regard to the above as well as the fact that the charge sheet has already been submitted, further detention of the petitioners may not be necessary. Accordingly, it is directed that the petitioners named above shall be released on bail on furnishing a bail bond of Rs. 50,000/- each with two sureties each of like amount to the satisfaction of the learned Special Judge, Morigaon in connection with the aforementioned case.
7. It is provided that the petitioners shall cooperate in the trial as and when trial commences and shall not try to tamper with the evidence or hamper the investigation of the case and shall not intimidate to any persons acquainted with the facts of the case in any manner.
8. The petition stands allowed. JUDGE Comparing Assistant
