By way of the present petition filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as the “BNSS”), the petitioner seeks quashing of FIR No. 332/2021 dated 19.07.2021, registered at Police Station Sagarpur, New Delhi, for the offences punishable under Sections 323/337 of the Indian Penal Code, 1860 (hereinafter referred to as the “IPC”), along with all consequential proceedings emanating therefrom, on the basis of the settlement arrived at between the parties.

5. The petitioner and Respondent No. 2 are present before this Court and have been duly identified by their respective learned counsel and the Investigating Officer concerned.
6. Briefly stated, the petitioner is the daughter-in-law of Respondent No.
2. The dispute between the parties arose in the context of matrimonial and family differences, pursuant to which the present FIR came to be registered. The parties thereafter continued to have disputes in relation to their respective matrimonial and maintenance claims. During the pendency of the proceedings, the parties, with the intervention of the Delhi Mediation Centre, Patiala House Courts, amicably resolved their disputes and executed a Settlement Agreement dated 29.03.2025. Under the terms of the settlement, the parties agreed to withdraw the cases/proceedings instituted by them against each other.

Learned counsel for the petitioner submits that, pursuant to the aforesaid settlement, Respondent No. 2 has agreed to cooperate in quashing of the present FIR and does not wish to pursue the criminal proceedings any further.

On a query made by this Court, Respondent No. 2, who has been duly identified by the Investigating Officer, states that she has entered into the settlement voluntarily, out of her own free will and without any force, coercion or undue influence. She further states that she has no objection if the present FIR and all consequential proceedings emanating therefrom are quashed. This is a digitally signed order. In view of the amicable settlement arrived at between the parties, the nature of the dispute, and the statement made by Respondent No. 2 that she does not wish to pursue the proceedings, no useful purpose would be served by continuing the criminal proceedings. Continuation thereof would only result in further litigation and acrimony between the parties.

Accordingly, FIR No. 332/2021, registered at Police Station Sagarpur, New Delhi, for the offences punishable under Sections 323/337 of the IPC, and all consequential proceedings emanating therefrom, including Criminal Case No. 10631/2021 titled “State v. Asha Tiwari”, pending before the learned Trial Court, are hereby quashed.
11. The present petition, along with all pending application(s), if any, stands disposed of.
12. Copy of this order be communicated to the concerned Trial Court for information and necessary compliance.
