2026:JHHC:15423 IN THE HIGH COURT OF JHARKHAND AT RANCHI A. B. A. No. 2753 of 2026 --- Mukesh Kumar, S/o Balaram Prasad, Resident of Village Pipra, PO & PS- Sughari, Dist-Nawada (Bihar). … … Petitioner(s) Versus The State of Jharkhand … … Opposite Party(s) --- CORAM : HON'BLE MR. JUSTICE RONGON MUKHOPADHYAY --- For the Petitioner(s) : Mr. Vivek Kumar, Advocate For the Opposite Party(s) : Spl.P.P. --- 2/26.05.2026 Heard Mr. Vivek Kumar, learned counsel for the petitioner and learned Spl. P.P. for the State. The petitioner is apprehending his arrest in connection with Siyaljori P.S. Case No.81 of 2025. It has been alleged that high-quality coal loaded in vehicle No.WB31N-0281 was found to have been replaced by low-quality coal. Submission has been advanced by the learned counsel for the petitioner that he has been implicated on the confessional statement of co-accused-Firdaus Ansari. It has further been submitted that the petitioner does not have any role in the entire offence and one of co- accused – Jitendra Nagbanshi @ Jitendra Nagwanshi @ Jitendra Nagbansi has been granted anticipatory bail by the Co-ordinate Bench of this Court in A.B.A. No.958 of 2026. Learned Spl. P.P. for the State opposed the prayer for anticipatory bail of the petitioner and has submitted that the petitioner has got two criminal antecedents. However, considering the manner of implication of the petitioner and the fact that there does not appear to be any role specified to the petitioner, I am inclined to extend the privilege of anticipatory bail to the petitioner. Accordingly, the petitioner above named is directed to surrender in the court below within four weeks and pray for bail, and in that event, he shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each, to the satisfaction 2026:JHHC:15423 of learned J.M. 1st Class, Bokaro in connection with Siyaljori P.S. Case No.81 of 2025, subject to the conditions as laid down under Section 482 (2) of the Bhartiya Nagrik Suraksha Sanhita, 2023. This application stands allowed.
