GP FOR HOME 2 The Court made the following: ORDER: The Writ Petition has been filed for the following relief: “…to to grant the following reliefs (a) Issue a Writ of Mandamus or any other appropriate writ/order directing Respondent No.2 to forthwith consider and dispose of the Petitioner's representation dt 25.03.2026, further (b) Issue a Writ of Prohibition restraining Respondent 3 , their subordinates, from Harassing the Petitioners or family for settlement or otherwise, consequently direct the respondents not to Arresting/detaining Petitioners without strictly following Section 35(6) BNSS procedure and Pass such other order(s) as deemed fit in the interest of justice …” 2. Heard learned counsel for the Petitioners and the learned Assistant Government Pleader. 3. Mrs. Kalla Tulasi Durgamba, learned counsel for the Petitioners, submits that the Petitioners submitted a representation on 25.03.2026, but the same has not been considered by Respondent No.2. 4. Sri P. Ajay Babu, learned Assistant Government Pleader, on written instructions, submits that a case has been registered against the Petitioners and that notices contemplated under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023, (for brevity, ‘the BNSS’) have been served upon them. 5. As seen from the representation dated 25.03.2026, the Petitioners have alleged that Respondent No.3 has been prejudicing them to compromise the matter. The Respondent Police have no authority to compel or prejudice the parties to compromise any criminal or civil case. If there are elements of settlement, the Respondent Police are permitted to refer the matter to the District Legal Services Authority (DLSA) or Mandal Legal Services Committee (MLSC). 3 6. Having regard to the facts and circumstances of the case, the Writ Petition is disposed of directing the Respondent No.2 to consider and dispose of the representation submitted by the Petitioners dated 25.03.2026 within a period of three (03) weeks from the date of receipt of a copy of this order. If the matter is referred by the Respondent Police to the Legal Services Authority, the Petitioners shall cooperate with such proceedings. 6. Accordingly, the Writ Petition is disposed of.
