This bail application has been filed under Sections 483 and 484 of the Bhartiya Nagrik Suraksha Sanhita, 2023 wherein, prayer has been made for grant of bail as the petitioner is in custody for allegedly committing offences punishable under Sections 64(1) of the Bharatiya Nayay Sanhita, 2023. 2. Heard, the learned counsel for the petitioner and learned counsel for the State and have also gone through the impugned order. 3. The learned APP opposes the prayer for grant of bail. 4. The prosecution story is that on 05.09.2025 at night while informant/victim opened the door of her room for nature’s call, suddenly the accused petitioner on the point of knife entered in her room and committed rape with her. On the next morning while her sister-in-law (gotni) called her to open the door then the accused on the point of knife fled away. 5. The petitioner claims that there is a love affair between him and the informant and when the fact was disclosed out of pressure, the F.I.R. was lodged. 6. From the F.I.R. I find that the petitioner stayed the whole night with the informant and the informant has not made any hue and cry which creates doubt about the prosecution story. 7. Considering the aforesaid facts, I am inclined to grant bail to the petitioner. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M. Ramgarh in connection with Rajrappa P.S. Case No.158/2025 subject to the condition that one of the bailors should be close relative of the petitioner having sufficient 2026:JHHC:6619 2 landed property in his/her own name within the State of Jharkhand. 8.
