This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.77/2024 registered at Police Station – Khadgaon, Distt.- GOURI MUDALIAR Digitally signed by GOURI MUDALIAR Date: 2026.01.13 11:59:38 +0530 2 Mohla-Manpur- Ambagarh Chauki (C.G.) for the offences punishable under Sections 420, 468, 470, 471, 120(B), 201/34 of Indian Penal Code. 2. Case of the prosecution, in brief, is that complainant Brijbhushan Deshmukh filed a written report stating that the present applicant, in collusion with other accused persons, fraudulently sold 15 acres of 2 land (Khasra Nos. 107/9, 101/6, 107/8, 107/9, 107/10, and 107/14) to Devendra Gupta for Rs. 13 lakhs. It is further alleged that the applicant, along with others, manipulated the online revenue portal to enter Devendra Gupta's name. Based on this incident, an FIR (Crime No. 77/2024) was registered against the co-accused and the applicant for the alleged offences. Ultimately, F.I.R. was lodged by the complainant. On basis of above facts, an offence has been registered against the applicant/accused. 3. Learned counsel for the applicant submits that the applicant is innocent patwari and he has falsely been implicated by the prosecution in the present case though he has not committed any manipulation in the online revenue record or cheating with anyone. He would submit that the land remains registered in the names of its rightful owners, who have not filed any complaints, the applicant was not posted at the time of incident. He would submit that the co-accused namely Sanjay Mishra has been granted anticipatory bail by this court in MCRCA No.98/2025 on 17/01/2025. He would submit that the applicant is permanent 3 resident of address shown in the cause title and there is no chance of his absconding or tampering with the prosecution witnesses, therefore, he submits that the present applicant is entitled to be released on anticipatory bail. 4. On the other hand, learned State counsel, appearing for the non - applicant/State, opposes the prayer for grant of anticipatory bail. 5. I have heard learned counsel for the parties and perused the material available on record. 6. Considering the facts & circumstances of the case, submission of learned counsel for the parties, material available on record, further considering the fact that the applicant has already been suspended from service because of the allegations made in the FIR and the FIR has also been lodged and he has come up before this court for grant of anticipatory bail, considering the fact that investigation and trial are likely to take some time, without further commenting anything on the merits of the case, I am inclined to grant anticipatory bail to the present applicant. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant –Hemant Kumar Thakur, on executing a personal bond and one surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) The applicant shall not directly or indirectly make any inducement, threat or promise to any person 4 acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) The applicant shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) The applicant shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial. (d) The applicant and the surety shall submit a copy of his adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
