Learned advocate for the petitioner submits that the petitioner was arrested on 08.08.2025 and since then he is in custody for about seven months. According to the learned advocate, charges have been framed, as such, he prays that the petitioner may be enlarged on bail. Learned advocate for the State opposes the prayer for bail and produces the case diary as also a report. The report speaks that the victim girl was notified by the State. Let the report be kept with the record. The attention of the court has been drawn to the statement of the victim under Section 183 of the BNSS. I have taken into account the period of detention of the present petitioner and having regard to the same,
2 without entering into the merits of the case, I am inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is Allowed. Accordingly, the petitioner viz, XXX shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the Learned Special Court under POCSO Act, Barrackpore. If on bail, the petitioner shall also make himself physically available on each and every date so fixed by the learned trial court and shall not leave the district of 24 Parganas, North without prior intimation to the learned Special court. Additionally, it is directed that the petitioner shall not enter into the jurisdiction of Bizpur Police Station till further orders of this court and he will inform his place of residence to the Officer-in-charge of Bizpur Police Station as well as the learned trial. In case, there is any violation of the aforesaid conditions, the learned trial court would be at liberty to cancel the bail without further reference of this court.
Accordingly, CRM(M) 312 of 2026 is allowed.
