JUSTICE LALITHA KANNEGANTI Digitally signed by YASHAVANT NARAYANKAR Location: HIGH COURT OF KARNATAKA - 2 - HC-KAR NC: 2026:KHC-D:1722 WP No. 109852 of 2025 ORAL ORDER The present writ petition is filed seeking the following prayer: “PRAYER Therefore, the Hon’ble Court may please to a) Issue a writ of mandamus direction against respondent no.1 & 2 to consider the representation of petitioner dated 24.10.2025 as per Annexure-A. b) Issue any order or direction in the nature of writ as this Hon’ble Court thinks fit in the facts and circumstances of the case.” 2. It is the case that the petitioner is the owner of the building constructed in Sy.No.224+225, Plot No.05, bearing PID No.17/2612, ward No.17, located at Ravindra Nagar, Dharwad. After completion of building construction, the petitioner has leased out the building to the respondent authority for a period of 3 years commencing from 01.01.2023 till 31.12.2025. The respondents authority in pursuance of lease has occupied the premises and utilized the same for ladies hostel. It is the grievance of the petitioner that without completing the period of 3 years, they have vacated the premises. The respondent authority without even informing the petitioner vacated the premises. - 3 - HC-KAR NC: 2026:KHC-D:1722 WP No. 109852 of 2025 3. Earlier, the petitioner had filed WP.No.107089/2025 seeking a mandamus to consider the representation dated 24.10.2025. But the same was rejected on the ground that the writ petition was filed immediately after the representation submitted to the respondent and no time has been granted to the authority. This writ petition is filed on 15.12.2025. It is stated that they have waited for 2 months and as there is no response, the petitioner has come up before this Court. It is the contention of the learned counsel for the petitioner that due to the pendency of this writ petition, an amount of Rs.4,53,000/- is paid by the respondent. 4. Learned Additional Government Advocate submits that the petitioner in his representation has raised several disputed questions of facts and the same cannot be decided by this Court. 5. Having heard the learned counsels on either side, perused the entire material on record. The petitioner has given a representation stating that there are certain outstanding amounts to be paid by the respondents. Whether the petitioner is entitled or he is not entitled, there is a responsibility/obligation cast upon the respondents to reply to the same. Unfortunately, - 4 - HC-KAR NC: 2026:KHC-D:1722 WP No. 109852 of 2025 there is no reply received by the petitioner. In that view of the matter, this Court is passing the following: ORDER i. The respondent Nos.1 and 2 shall consider the representation of the petitioner dated 24.10.2025 within a period of six weeks from the date of receipt of copy of the order and shall pass appropriate orders in accordance with law. ii.
