Petitioner has filed this writ petition seeking following reliefs. “10.1 That, this Hon’ble Court may kindly be pleased to issue a writ/ writs, direction/ directions, order/ orders and quash the impugned order dated 01.12.2025 passed by Secretary Divisional Level Committee and joint Director, Surguja Division, Ambikapur C.G. (Annexure P-1) and transfer order dated 04.06.2025 passed by the District Education PAWAN KUMAR JHA Digitally signed by PAWAN KUMAR JHA 2 / 3 Officer, District Level Rationalization Committee, District Balrampur-Ramanujganj (Annexure P-2). Further the respondent authorities may kindly be directed to take a fresh decision strictly in accordance with the guidelines dated 02.08.2024 and transferred policy dated 05.06.2025 and taking into consideration the other factual aspects. 10.2 That, this Hon’ble Court may kindly be pleased to grant any other relief(s), which is deemed fit and proper in the aforesaid facts and circumstances of the case.” 2. Learned counsel for petitioner submits that petitioner is holding the post of Lecturer (Economics) and posted at Government Higher Secondary School, Rajpur, District Balrampur has been transferred to Govt. Boys Higher Secondary School, Kusmi under rationalization scheme of the State Government. She contended that petitioner aggrieved with place of posting has submitted representation/ appeal before the Divisional Level Committee constituted by the State Government under the rationalization policy raising grounds that the petitioner is not keeping her health good and the post of Lecturer (Economics) is lying vacant at Govt. Higher Secondary School, Gopalpur which is nearby the District Hospital, Balrampur. However, the representation/ appeal submitted by petitioner was not considered in appropriate manner and rejected the application/ representation in mechanical manner. She further submits that after dismissal of representation submitted by petitioner at the time of filing of writ petition, petitioner came to know that post of Lecturer (Economics) is vacant at Govt. Higher Secondary School, Gopalpur and therefore petitioner can be posted in said school at Gopalpur under rationalization scheme. 3. Learned State counsel submits that pursuant to the observation made by this Court in pre-lunch session, she has sought instruction and as per her instruction submission of counsel for petitioner with respect to vacancy available of Lecturer (Economics) at Govt. Higher Secondary School, 3 / 3 Gopalpur is correct. The said post became vacant on account of promotion of Lecturer therein. She further submits that petitioner is having alternate remedy of preferring an appeal at the State Level Committee headed by DPI and in that appeal petitioner can raise that ground also. 4. I have heard learned counsel for the parties. 5. On due consideration of the submission of learned counsel for the respective parties, nature of grievance raised in this writ petition, in particular the submission of learned counsel for petitioner that petitioner is suffering from some medical ailment and further considering that post of Lecturer (Economics) is lying vacant at Govt. Higher Secondary School, Gopalpur, this writ petition at this stage is disposed of permitting the petitioner to submit appropriate representation/ appeal before the State Level Committee headed by DPI raising all those grounds also along with other grounds within a period of 10 days from today and if such an appeal/ representation is submitted, the concerned authority shall consider and take decision on the appeal/ representation submitted by petitioner, in accordance with law expeditiously preferably within a further period of 03 weeks from the date of receipt of representation. 6. Till the representation of petitioner is considered and decided, post of Lecturer (Economics) lying vacant at Govt. Higher Secondary School, Gopalpur shall not be filled up by posting another employee. 7. Accordingly, this writ petition stands disposed of with the aforesaid observation and direction.
