In this petition the petitioners who are the students aspiring their carrier in the field of nursing have filed these petitions under Article 226 of the Constitution of India with a prayer that last date fixed for admission for the first year of Nursing Course on 31.12.2025 may be extended to the convenience to the petitioners. 2.
Counsel for the petitioner would submit that the petitioners have secured less marks in the nursing admission conducted by the Chhattisgarh Professional Examination Board (VYAPAM), Raipur, as such earlier there were no occasion to get admission and subsequently on 29.12.2025 the responded No. 6 has reduced the percentage for getting admission in the nursing course. He would further submit that since the percentage has been reduced therefore, an opportunity has come for admission in the nursing course and would pray for extending last cut off date i.e. on 31.12.2025 which has already been expired. He would further submit that the guild-lines issued by Nursing College of India has not been followed is strictly and non compliance of that may vitiate the entire action taken by the State Government. 4.
On the other hand, learned counsel for Respondent No. 6 would submit that since Nursing Council of India has not extended last date for admission, as such this Court cannot grant any relaxation, as it is prerogative of Nursing Council of India. He would submit that in catena of judgment the Hon’ble Supreme Court has examined the issue that cut off date has not been extended by the High Court under Article 226 of the Constitution of India, as
6 in professional course no last date can be extended by the High Court and it is within the demon of highest body of the faculty in the case of Dental admission, Dental council of India as well as in surgery, National Medical Commission of India, as such both the writ petitions are not maintainable at this juncture and would pray for dismissal of the writ petitions. 5. I have heard counsel for the parties and perused the records. 6. Considering the submission and the law laid down by the Hon’ble Supreme court and also considering the fact that vide Annexure P/2 dated 29.12.2025 though the percentage has been reduced by the Nursing College of India, it has not extended the time period and the time period has already been expired on 31.12.20255 itself, therefore, no writ of mandamus can be issued to the respondents to extend the cut off date for admission in nursing course as it is within the domain of Nursing Council of India/ Respondent No. 6, therefore, I am of the view that no case is made out for interference by this Court.
