ORAL ORDER
(PER: THE HON'BLE MR. JUSTICE V.SRISHANANDA)
1. Heard Sri. Jagadish Patil, learned counsel for the petitioner, Smt. Kirtilata R. Patil, learned High Court Government Pleader for respondent No.1-State and Sri. K. L. Patil, learned counsel for respondent No.2. 2. Petitioner herein is the accused in FIR No.50/2022 of Raibag Police Station in respect of a road traffic accident. The offences alleged against the petitioner are under Sections 279, 337, 338 and 304A of Indian Penal Code, 1860. 3. The case of the petitioner is that he has also lodged the complaint in respect of the same incident and therefore, police are required to properly investigate the matter and file appropriate report. 4. In other words, if there is a complaint and counter complaint in respect of the same incident, Investigation Officer is required to investigate both the matters strictly as per the guidance issued by the full Bench

of this Court in the case of State of Karnataka by Circle Inspector of Police Vs. Hosakeri Ningappa and another1. 5.
Therefore, only on the ground that the petitioner has also lodged a complaint in respect of the opposite vehicle would not be sufficient to quash the pending FIR. 6. Accordingly, the following:
ORDER (i) The petition is dismissed. (ii) However, the Investigation Officer is
directed to adhere to the guidelines mentioned in the Hosakeri Ningappa (supra) and investigate both the matters in accordance with law.
