By this application filed under Section 483 of BNSS, 2023, the petitioner, namely, Sirajul Akand @ Sirajul Akon has prayed for regular bail, who was arrested on 05.09.2026, in connection with Gossaigaon P.S. Case No. 206/2026, registered under Sections 112/ 308(6)/ 308(7)/ 317(4)/ 318(4)/ Page No.# 2/3 319(2)/ 351(2)/ 351(3)/ 61(2)/ 3(5)/ 3(6)/ 3(8(/3(9) of the BNSS, 2023. 3. The FIR in connection with which the petitioner was arrested and was put behind the bars on 05.09.2026 was lodged by the Deputy Sub-Inspector of Police, Gossaigaon Police Station stating inter alia that the petitioner as well as the other persons alogwith them holding no office, no authority and no professional qualification of any kind used to stay in around the police station and they intercept the persons, who come to the police Station and also takes money from them. It is also alleged that the said petitioner in pursuance of their criminal conspiracy commits illegal deed and overt acts in pursuance of the said conspiracy. It is alleged that they intercept as stated above persons and they give false assumption of their authority to the said persons and by deciteful advice takes money from the public and also manufacture false criminal cases. 4. The learned counsel for the petitioner submits that the allegations narrated in the FIR are all vague and no specific allegations were made against the petitioner. He submits that the petitioner is an illiterate person and he cannot write his name and he is a daily wage labourer. The police arrested the petitioner without any basis, merely on suspicion. 5. Mr. K.K. Parasar, learned Additional Public Prosecutor, however, by placing the order of rejecting the bail by the learned SDJM, Gossaigaon objected for granting the privilege of bail to the petitioner till completion of the investigation. 6. Upon consideration of the submissions made by the learned Counsel for the parties, more so, in view of the fact that no specific allegation was made against the petitioner, who was working as a daily wage labourer, this Court deems it fit to enlarge the petitioner on bail on furnishing of bail bond of Rs. 20,000/- with one local surety of the like amount to the satisfaction of SDJM Page No.# 3/3 (M), Gossaigaon, under the following conditions: i) the petitioner will appear before the Investigating Officer thereafter as and when called for. ii) the petitioner will not hamper, tamper with the evidence, neither influence the witnesses connected with the case. iii) the petitioner will not leave the place of jurisdiction without the permission of the concerned Court. 7.
