Younush Mondal ..for the Petitioner Affidavit of service filed by the petitioner is taken on record. None appears for the respondents despite service. Learned counsel for the petitioner submits that the petitioner is being regularly and continuously tortured by the private respondent who is her daughter in law. The petitioner lodged complaint in this regard before the police authority which has not been acted upon. Upon consideration of the submission made on behalf of the petitioner, this Court is of the view that since the petitioner alleges that the complaint lodged by her has not been acted upon by the police authority, she is at liberty to approach the jurisdictional Magistrate under Section 175 of the BNSS for redressal of her grievance. In the meantime, the police authority is directed to keep strict vigil in the area and render necessary assistance/protection to the petitioner as and when sought. The writ petition is accordingly disposed of. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
