The petitioners are apprehending their arrest in connection with Dugda P.S. Case No.47 of 2025, for the alleged offences registered under Sections 303(2) of Bharatiya Nyaya Sanhita, 2023, Section 21 of Mines and Minerals (Development & Regulation) Act, 1957, Rule 13 of Jharkhand Minerals (Prevention of Illegal Mining Transportation and Storage) Rule, 2017 pending in the Court of learned Judicial Magistrate, Bermo at Tenughat. 3. Learned counsel appearing for the petitioners submits that the petitioners have provided license of crusher and the crusher was closed, however, earlier stored stone chips was found in the crusher and for that allegation the FIR has been registered. She further submits that the 2026:JHHC:3911 --2-- A.B.A. No. 7496 of 2025 crusher was running on a valid license. 4. Learned counsel appearing for the State submits that allegations are there that in the said crusher 800 cft. of stone chips and about 250 cft. boulders were recovered and seized from the premises of M/s Mahto Stone Crusher and 500 cft. of stone chips and about 500 cft. boulders were recovered and seized from the premises of M/s Birendra Kumar Pandey Crusher. 5. In paragraph No.42 of the case diary, it has come that these petitioners in the investigation has produced the document including the CTO paper and it has been pointed out that the said crusher was closed and what was lying there that was of earlier period. In the attending facts and circumstances of this case, I am inclined to provide anticipatory bail to the petitioners. 6. Accordingly, the petitioners, above named, are hereby directed to surrender before the learned Court within three weeks from today, and in the event of their surrender/arrest, the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate, Bermo at Tenughat in connection with Dugda P.S.
