Learned counsel for the petitioner submits that the petitioner is in custody in connection with Spl. POCSO Case No. 83/2024 arising out of Chutia P.S. Case No. 121/2024 for the offence registered under Section 376AB, after which charge has been framed under Sections 376 (2)(i) of the Indian Penal Code and Section 4(2) of POCSO Act, now said to have been pending in the court of learned A.J.C. IV-cum-Spl. Judge, POCSO, Ranchi. 2. Learned counsel for the petitioner submits that the petitioner is in custody since 31.05.2024 and has been falsely implicated in this case. He submits that in the case-diary, the witnesses have not supported the case. 3. Learned counsel for the opposite party-State has opposed the prayer and has submitted that the victim was only 12-13 years of age and she has supported the prosecution case in her statement recorded under Section 164 of Cr.P.C., wherein she has stated that she had gone to take ration in the shop and when she was going to the shop, one person came in a tempo and forcibly made her to sit in the tempo and pulled her and taken away and at the point of knife, he committed wrong with her and somehow she escaped and when reached home she disclosed the name of the petitioner. 2026:JHHC:6388 2 4. After hearing the learned counsel for the parties and considering the serious nature of allegation and that the petitioner has been named in the FIR, this Court is not inclined to enlarge the petitioner on bail.
