Municipal Corporation of Delhi’ pending before the Appellate Tribunal, MCD (‘ATMCD’). 2. The respondent/MCD had passed a demolition order against House No.805, Gali No.41, Chattarpur Pahadi, 100 Foota Road, New Delhi. Against the said order, the petitioner had filed an appeal before the ATMCD, wherein interim protection was granted in respect of House No.806 Gali No.41, Chattarpur Pahadi, 100 Foota Road, New Delhi. The relevant extracts from the order passed by the ATMCD are set out below:- “Till the next date of hearing, no coercive action be taken against the property of appellant i.e. bearing no. 806, Chhattarpur Pahadi, 100 foota Road, New Delhi in pursuance of the demolition order dated 09.09.2025. This interim order shall not come in the way of any order/directions passed by the Hon’ble High Court as well as Hon’ble Supreme Court of India. It is also made clear that no encroachment on the public land in protected. The appellant is directed not to raise any further construction in the property in question. MCD is at liberty to take action in pursuance to this demolition order against property no. 805, Chhattarpur Pahadi, 100 foota Road, New Delhi.” 3. From a reading of the above, it is manifest that the protection has been afforded only to House No.806 and not House No.805. 4. Counsel for the petitioner submits that the petitioner is the owner and resident of House No.806 and not 805. 5. In view thereof, the present petition is disposed of while directing that till the disposal of the appeal filed by the petitioner before the ATMCD, being Appeal No.511/2026, the respondent/MCD shall not take any action in respect of House No.806, Gali No.41, Chattarpur Pahadi, 100 Foota Road, New Delhi.
