JUSTICE MRIDUL KUMAR KALITA ORDER 18.09.2026 [1] Heard Ms. R.D. Mozumdar, the learned counsel for the applicant. [2] On perusal of the Office Note dated 16.09.2026, it appears that notices issued to opposite party Nos. 1 and 2 have been duly served. [3] This interlocutory application has been preferred by the Oriental Insurance Company Ltd. under Section 5 of the Limitation Act, 1963, praying for condonation of delay of 81 days in preferring the connected appeal, whereby the judgment and award dated 03.02.2026, passed by the learned Commissioner of Employee’s Compensation, Barpeta, in E.C. Case No. 280/2022, has been impugned. [4] The learned counsel for the applicant submits that the applicant has stated the reasons for delay in paragraph Nos. 3 to 8 of the instant interlocutory application. [5] After going through the said grounds, this court is of the considered opinion that the grounds stated therein may be regarded as sufficient cause which prevented the applicant/insurance company in preferring the connected appeal within the prescribed period of limitation. [6] As such, the delay of 81 days in preferring the Page No.# 3/3 connected Miscellaneous First Appeal is hereby condoned and this interlocutory application is allowed. [7] The Registry shall register the connected Miscellaneous First Appeal and list the same for admission after a week, on a date to be fixed by the Registry. JUDGE Comparing Assistant
