Petitioner herein seeks quashing of FIR No. 260/2024 dated 01.05.2024, registered at P.S. Vikaspuri, for commission of offences under Sections 448/451/380/34 IPC, along with all consequential proceedings arising therefrom, on the basis of compromise arrived at between the parties. 2. As per the allegations appearing in the FIR, the complainant/respondent No.2 claimed that the petitioner herein, who is his real elder brother, along with his son and one unknown person, trespassed into his shop situated in Flat No.197, Ground Floor, Site-III, Vikaspuri, New Delhi, which was in his possession and was being used by him as a godown. It is alleged that the complainant, upon checking the CCTV footage, noticed Signed By:SONIA THAPLIYAL Signing Date:18.08.2026 18:43:35 Signature Not Verified CRL.M.C. 5988/2026 2 that the petitioner was cutting the lock of the said shop with a machine and thereafter, replaced the same with his own lock. 3. Charge-sheet has not yet been filed. 4. Quashing is being sought for the reason that parties, who are real brothers, have amicably settled all their disputes with the intervention of family members and well-wishers and have entered into a comprehensive Memorandum of Understanding (MoU) dated 25.11.2024 and, therefore, respondent No. 2 is not interested in pursuing with the aforesaid FIR. 5. Copy of such MoU has also been placed on record. 6. Respondent No.2 is present in the Court and has been duly identified by the investigating officer as well as by his counsel. 7. When asked, Respondent No.2 submitted that he has entered into settlement voluntarily, without any coercion, pressure, force or influence from any corner whatsoever. He submits that both the parties have entered into a comprehensive MoU and considering that the dispute is, essentially, familial in nature, all grievances between them have now been amicably resolved and, therefore, he would have ‘no objection’ if the FIR in question is quashed. 8. Keeping in mind the aforesaid and considering that the parties are real brothers, continuation of further proceedings would only deepen the discord and disturb the familial harmony which the parties have now chosen to restore. Accordingly, exercising inherent powers vested in this Court under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023, it is deemed appropriate to quash both the FIR in order to facilitate both the sides in maintaining and restoring cordiality. 9. Vikaspuri, for commission of offences under Sections 448/451/380/34 IPC, along with all consequential proceedings arising therefrom, is hereby quashed. 10. MoU dated 25.11.2024 and original affidavits of the parties, copies of which have been filed with the present petition, and proof of deposit of cost shall be submitted before the concerned SHO/IO within a period of two weeks. 11.
