This is Third anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.255/2023 registered at Police Station – Takhtpur, District- Bilaspur (C.G.) for the offences punishable under Sections 4, 6, 10 of Agricultural Cattle Preservation Act and 11(1)(A), 11(1)(D) of Prevention of Cruelty to Animals Act. 2. The first anticipatory bail application filed by the applicant was rejected on merit by this Court in MCRCA No.1044 of 2025 vide order dated 16.07.2025. The Second anticipatory bail application filed by the applicant in MCRCA No.1926 of 2025 vide order dated 05.12.2025 was dismissed as withdrawn. 4. Prosecution case in brief is that on 24.05.2023, the constable of P.S. Takhatpur has received a information on his mobile that the members of Hindu Raksha Dal of Araiband Bilaspur have caught a truck and container in which cattle’s were loaded for their slaughter. Upon receiving the information, complainant has reached to the place with cattles. On the above allegation FIR has been lodged against the applicant. 5. Learned counsel for the applicant submits that the applicant is innocent and he has falsely been implicated in the present case. He would submit that the first anticipatory bail application filed by the applicant was rejected on merit by this Court in MCRCA No.1044 of 2025 vide order dated 16.07.2025 and the Second anticipatory bail application filed by the applicant in MCRCA No.1926 of 2025 vide order dated 05.12.2025 was dismissed as withdrawn. Further more investigation and trial are likely to take time, therefore, he submits that the present applicant is entitled to be released on anticipatory bail. 6. On the other hand, learned State counsel opposed the prayer for grant of anticipatory bail and submits that a large number of cattle were found, brutally loaded in truck, taken to slaughter house for slaughtering, therefore, he is not entitled to be granted anticipatory bail. 7. I have heard learned counsel for the parties and perused the case diary. 3 8. Considering the facts & circumstances of the case, gravity of offence, submissions made by learned counsel for the parties, allegation levelled against the applicant and also considering the fact that the first anticipatory bail application filed by the applicant was rejected on merit by this Court in MCRCA No.1044 of 2025 vide order dated 16.07.2025 and the Second anticipatory bail application filed by the applicant in MCRCA No.1926 of 2025 vide order dated 05.12.2025 was dismissed as withdrawn, further there appears to be no new ground. as such, I am not inclined to grant anticipatory bail to the applicant. 9. Accordingly, the anticipatory bail application of the applicant– Rahul Choragade filed under Section 482 of Bhartiya Nagarik Suraksha Sanhita, 2023 involved in Crime No.255/2023 registered at Police Station – Takhtpur, District-Bilaspur (C.G.) for the offences punishable under Sections 4, 6, 10 of Agricultural Cattle Preservation Act and 11(1)(A), 11(1)(D) of Prevention of Cruelty to Animals Act, is rejected. 10. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 11.
