Learned counsel for the petitioners would submit that the Investigating Officer, after conducting a thorough investigation, has filed the charge-sheet against the petitioners. He would further submit that, while matrimonial proceedings are pending between petitioner No.1 (husband) and respondent No.2 (wife), the respondent No.2 has filed a false complaint against the petitioners. The above submission is subject matter of trial inasmuch as the list witness of the prosecution in their statements has supported the version of L.W1. Be that as it may, the learned counsel for the petitioners submits that the present Criminal Petition may be disposed of by dispensing with the personal appearance of the petitioners before the learned trial Court.
