The applicant has preferred this First Bail Application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail, as he has been arrested in connection with Crime No.338/2025, registered at Police Station – City Kotwali Rajnandgaon, District : Rajnandgaon (C.G.) for the offence punishable under Sections 191(2), 191(3), 190, 109 of Bharatiya Nyaya Sanhita, 2023 and Sections 25 and 27 of Arms Act. 2. The case of the prosecution, in brief, is that on 04.07.2025, the father of PREETI KUMARI Digitally signed by PREETI KUMARI Date: 2026.01.09 16:13:31 +0530 2 the injured lodged a complaint at the concerned police station stating that on the same day, while he was present in his locality, he received a phone call from his elder son informing him that his son, Mahfuj Sheikh, had been assaulted at Rajnandgaon and was admitted to the hospital. Immediately thereafter, he reached Pendri Hospital, Rajnandgaon, where he found his son injured and undergoing treatment. The injured informed him that he had gone to meet his friend Shailendra at Triveni Sangam, where he had an argument with Nikhil Ramteke. Thereafter, he went to the Court, and while returning home at about 4:30 PM, near Pyarelal Chowk under the overbridge, two motorcycles arrived carrying Sohel Miya, Kastu Sahu, Bhaskar Khan, Taksh Pitar, the present applicant, and Nikhil Ramteke. It is alleged that Sohel Miya, the present applicant, Bhaskar Khan, and Kastu Sahu alighted from the motorcycles, picked a quarrel with him, and assaulted him with a knife. Based on this information, Crime No. 338/2025 was registered for offences punishable under Sections 191(2), 191(3), 190, and 109 of the Bharatiya Nyaya Sanhita, 2023, and Sections 25 and 27 of the Arms Act against the applicant and other accused persons. 3. It is argued by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated in this case. He further submits that the applicant along with co-accused Bhaskar Khan has assaulted the injured with knife and the bail application of co-accused Bhaskar Khan has been rejected by this Court vide order 14.11.2025 passed in MCRC No. 9196/2025 but the applicant is in jail since 05.07.2025 and he has no previous criminal antecedents. He also submits that the charge-sheet has been filed in this case and trial is likely to take quite long time for its conclusion, therefore, he prays for grant of bail. 3 4. On the other hand, the learned State Counsel opposed the bail application and submitted that the charge sheet has already been filed. He further submitted that the applicant, along with co-accused Bhaskar Khan, assaulted the injured, Mahfuj Sheikh, with a knife, as a result of which the injured sustained stab injuries that were found to be dangerous to life. Furthermore, in the present crime number, the bail applications of co-accused persons has already been rejected in MCRC No. 9196/2025 vide order dated 14.11.2025. Therefore, the applicant is not entitled to be released on bail. 5. I have heard learned counsel for the parties and perused the documents available on record. 6. Taking into consideration the facts and circumstances of the case, the nature and gravity of the allegations levelled against the applicant, and the fact that the applicant, along with co-accused Bhaskar Khan, assaulted the injured, Mahfuj Sheikh, with a knife, as a result of which the injured sustained stab injuries that were found to be dangerous to life, furthermore, the bail applications of co-accused person has already been rejected by this Court passed in MCRC No. 9196/2025 vide order dated 14.11.2025, this Court is of the opinion that this is not a fit case to enlarge the applicant on regular bail. 7. 7. Accordingly, the bail application of the applicant - Maruf Khan involved in Crime No.338/2025, registered at Police Station – City Kotwali Rajnandgaon, District : Rajnandgaon (C.G.) for the offence punishable under Sections 191(2), 191(3), 190, 109 of Bharatiya Nyaya Sanhita, 2023 and Sections 25 and 27 of Arms Act, is rejected at this stage. 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 4 9.
