JUSTICE V.SRISHANANDA) 1. Heard Sri.Shreedhar Kottershetty, learned counsel for Sri.Santosh S. Nagarale, learned counsel appearing for petitioners, Smt.Kirtilata R. Patil, learned High Court Government Pleader, appearing for respondent No.1-State and Sri.S.F.Kusalapur, learned counsel appearing for respondent No.2 to 5. 2. The petitioners/accused have filed the present petition with following relief: “Wherefore, it is humbly prayed that this Hon’ble Court may be pleased to quash the criminal proceedings in Special Case No.477/2025 pending before the III Addl. District and Sessions Judge (exclusive Special Court constituted for offence Triable under Schedule Castes and Schedule Tribes (Prevention Of Atrocities) Act) at Belagavi (vide annexure-A) for the offences punishable under Crime No.60/2025 Katkol P.S. for the alleged offences punishable u/s 3(1)(r), 3(1)(s), 3(2)(va) of the sc/st (prevention of atrocities act) act 2015 and section 189(2), 191(2), 191(3), 126(2), 115(2), 118((1), 352, and 351(2) r/w 190 of BNS - 4 - HC-KAR NC: 2026:KHC-D:2037 CRL.P No. 100066 of 2026 and consequently quash the charge sheet (vide annexure-A), in the interest of justice.” 3. The Parties are present before the Court along with their respective counsel. They have filed an application seeking compounding of the offences, supported by the affidavits of the injured/complainant. 4. On enquiry, the parties submit that they have agreed to settle the dispute amicably, which occurred on the spur of the moment, and that they do not want to continue with both the criminal proceedings in order to maintain peace and tranquility at the family-home front. 5. The compromise entered into between the parties appears to be voluntary, and this Court is satisfied to dispose of the matter in terms of the compromise. 6. It appears that a trivial incident was blown out of proportion, resulting in the filing of the complaint and counter-complaint. In one case, the charge sheet has been filed, whereas in the other, the investigation is still pending. - 5 - HC-KAR NC: 2026:KHC-D:2037 CRL.P No. 100066 of 2026 7. Taking note of the true settlement arrived at between the parties, and though the offences alleged are non-bailable in nature, following the principles laid down by the Hon’ble Supreme Court in Ramgopal and Another vs. State of Madhya Pradesh1, this Court is of the view that the application seeking compounding is allowed and the pending proceedings are liable to be quashed 8. Accordingly, the following order: ORDER (i) The petition and the applications are allowed. (ii) Consequently, the criminal proceedings in Special Case No.477 of 2025 arising out of Crime No.60/2025 registered with Katkol Police Station, pending on the file of III Additional District and Sessions Judge, Belgavi (exclusive Special Court constituted for offence Triable under Schedule Castes and Schedule Tribes (Prevention Of 1 (2022) 14 SCC 531 - 6 - HC-KAR NC: 2026:KHC-D:2037 CRL.P No. 100066 of 2026 Atrocities) Act), insofar as the petitioners/accused Nos.1 to 6 are concerned, stand quashed.
