Smt Pooja Kumari W/o Shri Mohmmad Ashiq, Aged About 31 Years, R/o Durgapark Gali No. 14B, West Sagarpur, Police Station Sagarpur, New Delhi. (At Present Confined In Central Jail, Ajmer). ----Petitioners Versus The State of Rajasthan, through PP ----Respondent For Petitioner(s) : Mr. Vijay Chandel Mr. Mahendra Singh Jaiswal For Respondent(s) : Mr. Sudesh Saini, PP HON'BLE MR. JUSTICE GANESH RAM MEENA Order 09/01/2026 1. This bail application has been filed by the accused petitioners u/S 483 BNSS in connection with FIR No. 321/2025 registered at Police Station Gandhinagar, District Ajmer for offences punishable u/S 331(7), 309(6) & 3(5) of BNS. 2. At the very outset, learned counsel for the accused petitioner seeks permission to withdraw the bail application of the accused petitioner No. 1 Mohmmad Ashiq. 3. Accordingly, the bail application of accused petitioner No. 1 Mohmmad Ashiq is dismissed as withdrawn. 4. As regards the bail application of accused petitioner No. 2 Smt Pooja Kumari, learned counsel submits that she has been [2026:RJ-JP:808] (2 of 2) [CRLMB-168/2026] implicated in this case merely because she is the wife of accused petitioner Mohmmad Ashiq. Counsel further submits that a small kid of aged about 2 years of the accused petitioner Smt Pooja Kumari is also languishing in jail alongwith her. He also submits that the accused petitioner Smt Pooja Kumari has also sustained pregnancy and she is in custody since 21.11.2025 and if she is not released on bail, the small kid of two years has also to undergo custody and she will face trauma as she is pregnant. 3. Learned Public Prosecutor vehemently opposed the bail application. 4. Taking into consideration the submissions made by learned counsel for the accused petitioner and more particularly the fact that a small child is also in jail alongwith the accused petitioner Smt Pooja Kumari, this Court, without expressing any opinion on merits/demerits of the case, deems just and proper to enlarge the accused petitioner on bail. 5. Accordingly, this bail application is allowed and it is directed that accused-petitioner Smt Pooja Kumari shall be released on bail provided that she furnishes a personal bond in the sum of Rs. 1,00,000/- (Rupees One Lac Only), together with two sureties in the sum of Rs. 50,000/- (Rupees Fifty Thousand Only) to the satisfaction of the Trial Court with the stipulation that she shall appear before that Court or any Court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
