This Miscellaneous Case has been filed by the applicant seeking correction/modification of the order dated 19.09.2025 passed by this Hon’ble Court in W.P.(C) No. 4914 of 2025, titled “Kheduram Nishad vs. Project Director, National Highway Authority & Others”. Learned counsel for the applicant submits that the applicant/petitioner had filed Writ Petition (Civil) No. 4914/2025 before this Hon’ble Court seeking a direction to the respondent authorities to deposit the compensation amount relating to the petitioner’s land within a stipulated time, and vide order dated 19.09.2025, this Hon’ble Court was pleased to grant liberty to the petitioner to file an application under Section 36 of the Arbitration and Conciliation Act, 1996; however, due to an inadvertent typographical error on the part of the applicant, the petitioner’s name, age, parentage, village and tehsil were incorrectly mentioned in the cause title and paragraph 2 of the said order as “Kheduram, Age about 47 years, S/o Dashru, R/o Village Bhesma, Tehsil Tilda/Abhanpur, District Raipur (C.G.)” instead of the correct particulars, namely “Kheduram Nishad, Age about 73 years, S/o Dasharu Nishad, R/o Village Bemta, Tehsil Tilda, District Raipur (C.G.)”, which mistake could not be noticed earlier; the petitioner had also filed MCC No. 1145/2025 which was withdrawn with liberty to file afresh, and therefore, in view of the aforesaid facts and circumstances, it is most humbly prayed that this Hon’ble Court may kindly be pleased to allow necessary modification/correction in the order dated 19.09.2025 in the interest of justice. 3. No objection raised from the other side. 3 4. In view of the above facts and circumstances, and considering that no objection has been raised by the respondents, this Court is of the considered opinion that the MCC deserves to be allowed. 5. Accordingly, the MCC is allowed. The order dated 19.09.2025 passed in W.P.(C) No. 4914/2025 shall stand modified/corrected to the extent that wherever the petitioner is described as “Kheduram, Age about 47 years, S/o Dashru, R/o Village Bhesma, Tehsil Tilda, District Raipur (C.G.)”, the same shall be read as “Kheduram Nishad, Age about 73 years, S/o Dasharu Nishad, R/o Village Bemta, Tehsil Tilda, District Raipur (C.G.)”. 6. Except for the aforesaid correction, all other terms and directions contained in the order dated 19.09.2025 shall remain intact. 7. Accordingly, the instant MCC is disposed of.
