1. By way of this petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the petitioner assails an order dated 05.04.2024, by which the Trial Court dismissed his application under Section 311 of the Code of Criminal Procedure, 1973, and consequently seeks recall of respondent - complainant for cross-examination.
2. After some hearing, Mr. Govind Rishi, learned counsel for the petitioner, seeks permission to withdraw this petition. However, Mr. Rishi reserves the petitioner’s right to approach the Trial Court for permission to lead defence evidence, after the complainant’s evidence is recorded in other connected cases.
3. The petition, alongwith pending application, is dismissed as withdrawn, in view of the above.
