1. Applicant seeks regular bail in case FIR No. 0472/2024, registered at Police Station Tilak Nagar for commission of offences under Sections 309(4)/3(5) of Bharatiya Nyaya Sanhita, 2023 (corresponding Sections 392/34 IPC). 2. As per case of prosecution, a robbery took place on 24.09.2024. Complainant Sangeeta was on her way to Nirankari Satsung on foot. A bike came towards her. Two persons were riding such bike and the person on pillion seat, on the point of knife, forcibly robbed away her earrings. 3. of surveillance and CCTV footage. As per case of prosecution, earrings in question were also recovered during investigation but when Test Identification Parade (TIP) was conducted, surprisingly, complainant did not claim such earrings to be hers. So much so, during the investigation, when judicial TIP was got conducted, she failed to identify the accused. 4. Much water has flown down thereafter also as complainant i.e. PW2 Sangeeta has already entered into witness-box and in witness-box also, she reiterated that when she could not identify the accused persons during the TIP, there was no question of her identifying them in the witness-box, either. 5. Nominal Roll of the applicant has been requisitioned and it indicates his overall jail conduct to be satisfactory. 6. Keeping in mind the overall facts of the case and, in particular, the deposition of the complainant, no useful purpose would be served by permitting applicant to incarcerate. The applicant is, hereby, directed to be released on bail on his furnishing personal bond in a sum of Rs.
25,000/- with one surety of like amount, subject to the satisfaction of learned Trial Court/Chief Judicial Magistrate/Duty Judicial Magistrate First Class with the following conditions:- a) Surety would be local. b) Applicant shall appear before the learned Trial Court regularly on date(s) fixed. c) The applicant/accused shall provide his mobile number to the investigating officer and shall keep the same operational all the time, till the disposal of the case. 7.
