1. By way of this petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the petitioners seek quashing of FIR No. 176/2023, dated 25.04.2023, registered at Police Station Jamia Nagar, District South-East, Delhi, under Sections 498A/406/32 of the Indian Penal Code, 1860 [“IPC”], and all consequential proceedings emanating therefrom. Upon completion of investigation, a chargesheet was filed, and an offence under Section 354 of IPC was invoked against petitioner No. 3, while offences under Sections 354/506 of IPC were invoked against petitioner No. 9. 2. After some arguments, Mr. Dharmendra Kumar, learned counsel for the petitioners, seeks permission to withdraw this petition, without This is a digitally signed order. In view of the above, the petition, alongwith pending applications, is dismissed as withdrawn. 4. Further, Mr. Kumar states that as there are 11 members of the family, who have been summoned in the present case, he will seek appropriate orders from the Trial Court for furnishing of common sureties. This is also a matter which the Trial Court will consider in accordance with law. 5. It is clarified that this Court has not expressed any opinion on the merits of the case or on any petition that may hereafter be filed by the petitioners, which shall be considered by the appropriate Court on its own merits and in accordance with law.
