JUSTICE RAJESH SHANKAR For the Petitioner : Mr. Soumitra Baroi, Advocate For the State : Mr. Satish Prasad, A.P.P. 02/13.02.2026 The petitioner is an accused for the offences punishable under Sections 113(2)/113(3)/113(4) of the Bharatiya Nyaya Sanhita, 2023, Section 25(1-A)/25(6)/25(7),25(1-B)(a)/26/31/35 of the Arms Act and Section 17 of the C.L.A. Act. 2. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and has not committed any offence as alleged in the F.I.R. There is alleged recovery of one country-made pistol, one 8 mm live cartridge and one 8 mm used cartridge from the possession of the petitioner. In fact, there has been no such recovery from the possession of the petitioner as has been alleged. The false implication of the petitioner would be evident from the fact that the seizure list prepared in this regard does not bear signature of any independent witness. The petitioner is in judicial custody in connection with the present case since 13.06.2025. Though he has one criminal case pending against him, however he has been granted regular bail in the said case by a Bench of this Court. Hence, he may be given the privilege of regular bail. 3. Learned A.P.P. opposes the petitioner’s prayer for regular bail. 4. Having heard learned counsel for the parties and considering the materials available on record, I am inclined to enlarge the petitioner on bail. 2026:JHHC:4140 - 2 - 5. Accordingly, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Hazaribagh in connection with Keredari P.S.
