Surbhi and registered as Case Crime No. 0050 of 2025, under Sections 85, 352, 74, 89 BNS, and Section 3/4 Dowry Prohibition Act, Police Station - Mahila Thana, District - Meerut. 4. Present writ petition came up for admission on 12.09.2025 and this Court passed the following order. "The present petition has been filed challenging the First Information Report dated 04.06.2025 registering Case Crime No. 0050 of 2025, under Sections 85, 352, 74, 89 B.N.S., 2023 as well as Section 3/4 Dowry Prohibition Act, 1961, Police Station-Mahila Thana, District-Meerut. It has been argued by learned counsel for the petitioners that the first information report could not have been registered in Meerut and the Mahila Thana or the police of Meerut or in any district in Uttar Pradesh does not have the jurisdiction to investigate into the allegations as made in the first information report. It has been argued that no act is said to have been committed by the petitioners in any district in Uttar Pradesh and, therefore, even if the offences are continuing offences, Section 198(c) is not applicable in the present case. It has been further argued that the first information report is false and has been lodged only to settle the dispute with petitioner No. 2 who had filed the complaint against the parents of respondent No. 3, who had allegedly cheated the petitioner No. 2. The matter requires consideration. The A.G.A. represents the respondent Nos. 1 and 2. Issue notice to respondent No. 3. The respondents may file their counter affidavit within eight weeks. The petitioner shall have four weeks thereafter to file his rejoinder affidavit. List after expiry of the aforesaid period before appropriate Bench. The matter shall not be treated as tied up or part heard with this Bench. Meanwhile, no coercive action shall be taken against the petitioners in pursuance of the First Information Report dated 04.06.2025 registering Case Crime No. 0050 of 2025, under Sections 85, 352, 74, 89 B.N.S., 2023 as well as Section 3/4 Dowry Prohibition Act, 1961, Police Station-Mahila Thana, District-Meerut." CRLP No. 20504 of 2025 2 5. On the matter being taken up, Mr. Pradeep Kumar Mishra representing first informant - respondent 3 submits that during pendency of present writ petition, Investigating Officer, upon completion of statutory investigation of aforementioned case crime number, in terms of Chapter XIII BNSS, has already forwarded the charge sheet/police report dated 18.12.2025 as contemplated in Section 193(3) BNSS. Cognizance upon the same has also been taken vide order dated 27.01.2026 and by the jurisdictional magistrate in exercise of jurisdiction under Section 210 BNSS. 6. Considering the above, and also the law laid down by Apex Court in the case Pradnya Pranjal Kulkarni Vs. State of Maharashtra and Another, 2025 SCC OnLine SC 1948, the present writ petition has been rendered infructuous. It is accordingly dismissed as having rendered infructuous. 7. Interim order, if any, shall stand vacated. October 6, 2026 S.K.S. CRLP No. 20504 of 2025 3 (Jai Krishna Upadhyay,J.) (Rajeev Misra,J.)
