Heard Mr. Himanshu Sinha, learned counsel for the petitioner. Also heard Mr. B. Gopa Kumar and Mr. Himanshu Pandey, learned counsel appearing for the Respondent/CBI. 2. The present petition has been filed by the petitioner with the following prayer: "A. Stay further proceedings and/or restrain the Respondent from taking any coercive steps against ALOK SHARMA Digitally signed by ALOK SHARMA Date: 2026.01.13 11:22:43 +0530 2 the petitioner pursuant to the impugned FIR bearing RC 2182025A0014 dated 30.06.2025 registered under Section 61(2) of the Bharatiya Nyaya Sanhita, 2023 and Sections 7, 8, 9, 10, and 12 of the Prevention of Corruption Act, 1988, lodged by CBI New Delhi; and/or. B. Pass any further order as orders as this Hon’ble court may deem fit and proper in the facts and circumstances of the present case.” 3. At the very outset, learned counsel for the petitioner submits that the present petition be dismissed as withdrawn with liberty to the petitioner, to avail remedy, if any further cause of action arises. 4. It has been pointed out by the learned counsel for the CBI that though the petitioner is named in the FIR along with the co-accused, but in the charge-sheet which have been submitted he has not been named, and so far as the applicant is concerned, investigation is still pending. 5. In view of the above submissions made by the parties, the present CRMP is dismissed as withdrawn with liberty to the petitioner to avail appropriate remedy available under the law, if occasion so arises.
