Petitioner has filed this writ petition, seeking following reliefs:- ALFIZA BAIG Digitally signed by ALFIZA BAIG Date: 2026.01.24 11:53:59 +0530 2 / 3 “10.1 That, this Hon'ble Court may kindly be pleased to call for the entire records in connection of the petitioner’s cases. 10.2 That, this Hon'ble Court be further pleased to issue an appropriate writ directing the respondents to sanction and release regular family pension in favour of the petitioner forthwith. 10.3 That, the Hon’ble Court be further pleased to direct the respondents to release all pending retiral and death cum pensionary benefits of late Shri Phulsai Yadav, including arrears, gratuity and other admissible dues, within a time- bound period. 10.4 That the Hon’ble Court be further pleased to direct the respondents to decide the petitioner’s pending representations in a stipulated time as deemed fit by this Hon’ble Court. 10.5 Any other order that the Hon’ble Court deems fit and necessary in the circumstances of the case be also passed.” 2. Learned counsel for petitioner submits that husband of petitioner was an employee of respondent authority, however, he died in harness due to snake bite. He further submits that respondent department has not disbursed death - cum- retiral dues to petitioner. 3. Learned counsel for State opposes the submission made by learned counsel for petitioner and submits that petitioner has not pleaded correct facts in this writ petition, there is some dispute with regard to wife of deceased. One Daneshwari Bai has filed application for grant of succession certificate before competent Court at Sakti, Janjgir Champa 3 / 3 in which petitioner is also impleaded as respondent no. 6. She also submits that application is filed in the year 2022 and petitioner herein might also be participating in the said proceedings and therefore, relief as prayed for may not be granted in this writ petition. She lastly submits that in the death certificate which petitioner has filed as Annexure P-4 also mentions the name of Dhaneshwari Bai as wife of deceased Fulsay Yadav. 4. I have heard learned counsel for the respective parties. 5. Considering the nature of grievances as also considering the dispute with regard to succession which is pending consideration before the Court Sakti filed by Dhaneshwari Yadav in which petitioner is one of the non-applicant, I do not find any good ground to entertain this writ petition at this stage. Accordingly it is dismissed, however, reserving right of petitioner to pursue proceedings of grant of succession certificate pending at Court, Sakti.
