The petitioners are apprehending their arrest in connection with Dandai P.S. Case No.78/2025, registered for the offence under Sections 126(2), 115(2), 117(2), 109, 352, 351(2), 351(3), 74, 3(5) of the BNS and Section 3/4 of Prevention of Witchcraft Practices Act, pending in the Court of the learned Judicial Magistrate, 1st Class, Garhwa. 3. Learned counsel appearing for the petitioners submits that there are case and counter case between the parties and one incident is said to be of 11.08.2025, whereas, the FIR has been lodged on 14.08.2025. He further submits that the allegation of 13.08.2025 is also made and entire family members have been made accused. 4. Learned counsel appearing for the State opposed the prayer and submits that the allegations of assault and molestation are there against the petitioners. Looking into the contents of the FIR, it transpires that so far as the allegation of assault is concerned, that was firstly of dated 11.08.2025 against Shyamlal Chaudhary and that allegation is not against the present petitioners. It has been pointed out that there are case and counter case between the parties. The FIR has been lodged on 14.08.2025 in place of occurrence dated 13.08.2025, which is said to be second incident. In the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioners. 6. Accordingly, the above-named petitioners are directed to surrender before the learned Court within three weeks from today and in the event of their arrest or surrender, they shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Garhwa in connection with Dandai P.S.
