1 The present petition under Section 528 of BNSS, 2023 has been filed against the order dated 09.07.2025 passed by Additional sessions Judge, FTSC, (POCSO Act) Sarangarh, in Special Criminal Case (POCSO Act) No.36 of 2023, whereby the application filed by the applicant under Section 9 of the Juvenile Justice (Care and Protection of Children) Act, 2015, has been dismissed. 2 At the outset, learned counsel for the applicant would submit that the present petition has become infructuous as the plea of juvenile which INDRAJEET SAHU Digitally signed by INDRAJEET SAHU Date: 2026.01.12 18:47:58 +0530
2 was raised by the applicant before the trial court was rejected against which the present CrMP was filed and thereafter there was no interim
order in the present CrMP. He would further submit that meanwhile the trial of the applicant has ended in to his conviction, for which he has filed Criminal Appeal No.1976 of 2025 which is connected with this CrMP. Hence, the present CrMP is infructuous. 3 In view of above submissions made by the counsel for the applicant, the present CrMP stands dismissed as having become infructuous.
