(At Present Confined In District Jail, Karauli). ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Kartar Singh For Respondent(s) : Mr. Jaiprakash Tiwari, PP Mr. Vishnu Kumar Sharma HON'BLE MR. JUSTICE PRAMIL KUMAR MATHUR
Order 08/04/2026
1.
1. The petitioner has preferred this bail application under Section 483 of BNSS in FIR No.221/2025 registered at Police Sta- tion Balghat, District Karauli for the offence under Sections 103(1), 238(A), 61(2) and 3(5) of B.N.S., 2023.
2. Heard learned counsel for the petitioner, learned Public Pros- ecutor and counsel for the complainant and perused the material available on record.
3.
Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. Learned counsel for the petitioner further submits that no specific overt act has been at- tributed to the present petitioner. The only allegation against him is that he was present at the scene of the crime. Thus, there is no direct evidence connecting the petitioner with the alleged offence. It is further argued that the petitioner has been behind bars since

23.08.2025. The charge-sheet has already been filed and the trial is likely to take a considerable time. Therefore, no fruitful purpose would be served by keeping the petitioner in further custody and the bail application deserves to be allowed.
4. Per contra, learned Public Prosecutor as well as learned counsel for the complainant have vehemently opposed the bail ap- plication. They submit that the allegations against the present pe- titioner are grave and serious in nature. It is argued that the peti- tioner's name is specifically mentioned in the FIR and there is in- criminating material available on record, including the statements of witnesses. Therefore, according to them, the bail application is liable to be rejected.
5. Having considered the rival submissions and the material available on record, and after examining all the facts and circum- stances of the case, particularly the fact that the petitioner's name finds mention in the FIR and that the charge-sheet reflects that the petitioner, along with the other co-accused, strangulated the deceased, Devi Sahai, by putting a towel around his neck, this Court is not inclined to allow the present bail application.
6. Accordingly, the bail application under Section 483 B.N.S.S. is hereby dismissed.
