2. Mr. G.C. Joshi, learned A.G.A. for the State of Uttarakhand.
3. The Applicant- Harsh Chaudhary, is before this Court seeking Anticipatory Bail in connection with Case Crime No. 0348 of 2025, registered at Police Station Rishikesh, District Dehradun, for the offence punishable under Section 109(1) of the Bharatiya Nyaya Sanhita, 2023.

Learned counsel for the Applicant submits that the Applicant was granted ad-interim anticipatory bail by the Coordinate Bench vide order dated 30.07.2025. It is further submitted that the co-accused persons, namely, Vishal @ Shooter, Himanshu @ Prashant and Dikshit Kumar, have already been granted bail by the court below on 19.08.2025, 01.09.2025 and 04.09.2025, respectively. On the ground of parity and considering that the Applicant has complied with the interim order, it is prayed that the ad-interim protection so granted be made absolute.
5. Learned State Counsel opposes the Anticipatory Bail Application and submits that the investigation is still in progress. It is further submitted that from the vehicle allegedly used in the commission of the offence, a 315 bore country-made pistol was recovered, in respect of which a separate FIR has also been lodged.

Considering the submissions advanced, particularly that the allegations against the Applicant are stated to be false, that the vehicle in question does not belong to the present Applicant, and that the Applicant has been enjoying the benefit of ad- interim anticipatory bail since 30.07.2025 without misuse of liberty, this Court is of the view that no useful purpose would be served in curtailing the liberty of the Applicant at this stage.
7. Accordingly, the interim anticipatory bail granted vide
order dated 30.07.2025 is hereby made absolute.
8. The Applicant shall continue on bail subject to the conditions already imposed and further subject to the following conditions: (i) The Applicant shall attend the court proceedings as and when required and shall not seek unnecessary adjournments. (ii) The Applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the
facts of the case. (iii) The Applicant shall not leave the country without prior permission of the Court concerned.
9. There shall be no requirement for furnishing fresh bail bonds, as the Applicant has already executed the personal bond and sureties to the satisfaction of the court concerned.
10. Accordingly, the Anticipatory Bail Application stands
disposed of.
