BEFORE HONOURABLE MRS. JUSTICE SHAMIMA JAHAN ORDER Date : 22.09.2026 Heard A. Ali, the learned counsel for the petitioner and Mr. R. J. Baruah, the learned Addl. Public Prosecutor for the State of Assam. 2. By this application, the petitioner has prayed for bail in connection with Gorchuk P.S. Case No. 193/2026, registered under Section 103(1) of BNS, 2023. The FIR in connection with which, the petitioner was arrested and is puts behind the bars for the last 63 days was lodged by the police personnel from the Gorchuk Police Station on 23.07.2026, stating inter alia that an information was received that a dead body of an woman was found inside a rented house near ISBT under the jurisdiction of Gorchuk Police Station. It was further stated that upon receiving the information, the police personnel rushed to the place of occurrence and they found that the room belongs to one, Abdul Kadir Talukdar and was rented to the deceased and the petitioner, who were in relationship. An enquiry was conducted and it is found that, the petitioner had left the rented house on 19.07.2026, after locking the room from the outside and had not returned thereafter. On some suspicion when the room was opened, the body of the woman was found lying dead inside the rented premises. 4. The learned counsel for the petitioner submits that, the petitioner left the rented house on 19.07.2026, and went to Hajo to attend a marriage ceremony and from that place the police had arrested him. He submits that, he has no connection whatsoever, with the death of the deceased at the rented house. 5. Mr.
R. J. Baruah, the learned APP, on perusal of the Case Diary submits that, the deceased had died due to strangulation and that, the recreation of the scene was done by the Investigating Officer and during the same, the petitioner had stated and had shown, as to how he had committed the offence. He submits that there are witnesses to the recreation done and the witnesses have stated to that effect. 6. Upon consideration of the submissions made by the learned counsels, more so in view of the fact that, the body of the deceased was found in a
Page No.# 3/3 decomposed state, suggesting that the death have taken place two days before the body was recovered, this court does not deems it fit to enlarge the petitioner on bail at this stage. 7. The bail applications stands dismissed. JUDGE Comparing Assistant
