By this application filed under Section 438(1) of BNSS, the petitioner has prayed for stay of the operation of the impugned judgment and order dated 05.02.2026 passed by the Judicial Magistrate First Class, Dibrugarh in NI Case No. 166/2018 as well as for suspension of sentence passed therein. The petitioner has also prayed for the stay of the judgment dated 16.06.2026 passed by the Additional Sessions Judge, Dibrugarh in Criminal Appeal No. 19(1) of 2026. It is noticed that the Trial Court had ordered the applicant to pay the compensation amount or the fine amount of Rs. 9 lakhs within a period of 60 days and the Appellate Court by judgment and order dated 16.06.2026 had affirmed and upheld the judgment and order passed by the Judicial Magistrate First Class, Dibrugarh. Since the payment was directed to be made within 60 days and the same was upheld by the Appellate Court, this Court deems it fit to suspend the operation of the sentence passed in NI Case No. 166/2018 passed by the Judicial Magistrate First Class, Dibrugarh vide judgment and order dated 05.02.2026. This Court also for the ends of justice, stayed the operation of the judgment dated 16.06.2026 passed by the Appellate Page No.# 3/3 Court till the revision is disposed of by this Court.
