The present writ petition has been filed for the following reliefs:- “i. For issuance of a writ in the nature of Certiorari for quashing the part order dated 24.09.2025 vide Memo No.1838 (Annexure-8) issued by the Deputy Commissioner (Respondent No.4) whereby and whereunder it has been informed/directed to Head Master of D.A.V.+2 High School, Dhanbad to immediately contact the official of the Aarya Pratinidhi Sabha, Jharkhand and duly constitute a New Managing Committee in the school within the next one month which is against/violated the order passed by Hon'ble Division Bench of Jharkhand High Court Ranchi vide order dated 10.12.2003 in W.P. (PIL) No.3988 of 2002 in-spite of that the Hon'ble Division Bench held in aforesaid order that the School in question under the preview of Minority Status which is clearly violation 2026:JHHC:2062 2 W.P.(C) No.167 of 2026 of the aforesaid order passed by Hon'ble Division Bench since the authority has given the weightage to representative of Arya Samaj. ii. For direction upon the respondents to conduct the election as per order 10.12.2003 passed in W.P.(PIL) No.3988 of 2002 passed by this Hon'ble Court whereby the Deputy Commissioner will look into the relevant by laws the membership registered and other relevant record and call for General Body Meeting of the Members of the Societies for the compose of electing the managing committee in term of the bylaws and after the finalization of the election the same over handed to Management of the School the newly Elected Committee and the duty commissioner will continue his management as a receiver of the school. 2. After some argument, learned counsel for the petitioner seeks permission to withdraw the present writ petition with a liberty to work out his remedy in accordance with law. 3. Learned counsel for the other side have raised no objection. 4. Permission is accorded. 5. Accordingly, the present writ petition stands disposed of with the aforesaid liberty.
