.2026 Heard Mr. R. Sarma, learned counsel for the petitioner. Also heard Mr. P.P. Phukan, learned Standing Counsel, Gauhati University. 2] The petitioner’s husband namely Sri. Jatin Chandra Das was an employee of Gauhati University and because of serious injuries sustained on his right leg in a motor vehicle accident he was compelled to take voluntary retirement. The petitioner has been running from pillar to post seeking an appointment on compassionate ground. The petitioner claims that after retirement of her husband there is no source of earning. They have a minor child aged about 9 years. The petitioner filed a representation dated 09.01.2026 before the Registrar, Gauhati University. 3] Inspite of approaching the Office of the Registrar, Gauhati University requesting for consideration of the prayer made in the representation, no orders have been passed by the Registrar, Gauhati University. 4] The learned Standing Counsel, Gauhati University was permitted by the Court to obtain instructions as to whether there is a separate policy or scheme in force by the Gauhati University with regard to the compassionate appointment on account of voluntary retirement of the employee. 5] The learned Standing Counsel, Gauhati University submits that there is a scheme for compassionate appointment but there is no provision for
consideration of compassionate appointment for persons who voluntarily retired.
Page No.# 3/3 The scheme however, is not on record. 6] The learned counsel for the petitioner has a limited prayer before the Court and submits that the direction be issued to the Gauhati University authority to dispose of the representation dated 09.01.2026 filed by the petitioner which is pending before the concerned authority. 7] The learned Standing Counsel, Gauhati University does not object to the prayer made. 8] Considering the submissions made by the learned counsel for the parties, this writ petition stands disposed of directing the Registrar, Gauhati University to dispose of the representation dated 09.01.2026 filed by the petitioner taking into consideration the grounds made by the petitioner by causing a detail examination on the claims made by the petitioner in the representation dated 09.01.2026 and thereafter, if the claims are found to be genuine the case of petitioner may be considered sympathetically in terms of the Rules and Procedure which are followed by the Gauhati University. It is needless to say that any order, if that is passed, the copy of the same shall be furnished to the writ petitioner. The order shall be passed by the Gauhati University authority within a period of 30 days from the date of receipt of certified copy of this order. 9] In terms of the above, this writ petition stands disposed of.
