1. The present writ petition has been filed seeking a direction to the respondent/MCD to inspect the property bearing no.L-2/48, Gali No.13, New Mahavir Nagar, New Delhi – 110018 (hereinafter ‘subject property’) and take appropriate action in accordance with law.
2. Counsel appearing on behalf of the respondent/MCD submits that a show-cause notice dated 3rd August, 2026 has been issued under Section 344, sub-Sections (1) and (3) and Section 343 of the DMC Act, 1957 against the unauthorised construction in the subject property in the shape of ground floor, first floor, second floor and third floor. 3. A copy of the show-cause notice has been handed over in Court and the same is taken on record.
4. In view thereof, the present writ petition is disposed of while directing the respondent/MCD to take action in accordance with law.
5. The respondent no.1/MCD and respondent no.5/SHO, Police Station Tilak Nagar shall ensure that no unauthorised construction is carried out in the subject property.
6. Liberty is given to the petitioner to initiate appropriate proceedings in law in the event any further grievance survives.
7. All rights, contentions and legal remedies of the owner/occupier are kept open.
8. Pending applications stand closed.
