This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 have been filed by the applicants, who are apprehending their arrest in connection with Crime No.157/2025 registered at Police Station –Jhagrakhand, GOURI MUDALIAR Digitally signed by GOURI MUDALIAR Date: 2026.01.13 16:58:00 +0530 2 District-M.C.B. (CG) for the offence punishable under Section 308(2) of BNS, 2023 & Section 67 of IT Act. 2. Case of the prosecution, in brief, is that on the complaint made by the complainant Kishun Singh stating that daughter of the Applicants, Co-accused Pooja Singh Gond (earlier Pooja Ramteke) married to his son Pawan Singh Gond against his wishes and due to which he disowned his son and has no relation with the couple. After marital dispute, Pooja Singh Gond filed a maintenance case and during the pendency of which she sent messages to the complainant demanding Rs. 10 Lakh and also threatening social defamation and thereafter she circulated obscene social media messages and posts against complainant's daughter Anita alleging elopement and immoral conduct. On the basis of the complaint FIR has been registered by the Police of P.S. - Jhagrakhand on 09.10.2025 in connection with crime No. 157/2025 for the offence punishable under section 308(2) BNS and Section 67 of IT Act against the Applicants as well as their daughter Pooja Ramteke. 3. Learned counsel for the applicants submits that the applicants are innocent senior citizens who have been falsely implicated in this case solely due to matrimonial dispute between their daughter Pooja Singh Gond and her husband Pawan Singh Gond. It is submitted that the complainant, Kishun Singh Gond, is the father of Pawan Singh Gond, and the present FIR is a clear misuse of criminal law to pressurize the applicants and their daughter during 3 pending maintenance and matrimonial proceedings before the Family Court. He further submits that the applicants have no criminal antecedents and the applicants are suffering from age- related ailments. He would submit that the Applicant No. 1 is a retired teacher, upon whom her husband (Applicant No. 2) and Pooja Singh Gond's minor daughter, Ku. Pari, are financially dependent and the entire responsibility of care and financial expenses of the family rests upon Applicant No. 1. He would submit that the applicants are permanent resident of address shown in the cause title and there is no chance of their absconding or tampering with the prosecution witnesses, therefore, he submits that the present applicants are entitled to be released on anticipatory bail. 4. On the other hand, learned State counsel, appearing for the non - applicant/State, opposes the prayer for grant of anticipatory bail. 5. I have heard learned counsel for the parties and perused the material available on record. 6. Considering the facts & circumstances of the case, submission of learned counsel for the parties, material available on record, further considering the fact that the applicants are senior citizens and parents of the daughter-in-law of the complainant, and the dispute arises out of a matrimonial dispute between the parties, without further commenting anything on the merits of the case, I am inclined to grant anticipatory bail to the present applicants. 4 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicants Smt. Annapurna Ramteke & Uday Ramteke, on each of them executing a personal bond and one surety in the like sum to the satisfaction of the arresting Officer, they shall be released on bail on the following conditions:- (a) The applicants shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) The applicants shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) The applicants shall appear before the trial Court on each and every date given to them by the said Court till disposal of the trial. (d) The applicants and the surety shall submit a copy of their adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
