This bail application has been filed on behalf of Baiju Ravidas who is in custody since 07.08.2024 in connection with S.T. No. 552 of 2024 arising out of Pirtand P.S. Case No. 18 of 2024 for the offence registered under Sections 103(1) and 238 of the BNS, 2023 pending in the Court of learned Addl. Sessions Judge- IV, Giridih, is pressed into motion. Earlier bail application of the petitioner was rejected on merit vide order dated 26.03.2025 passed in B.A. No. 2423 of 2025 by Co-ordinate Bench of this Court and thereafter, B.A. No. 5343 of 2025 vide order dated 08.08.2025 was also rejected by the same Bench. The present bail application is being renewed on the ground that three witnesses have been examined and at the penultimate stage of trial, they have filed petition under Section 311 of Cr.P.C. Learned A.P.P. for the State opposed the prayer for bail. This Court is of the view that mere filing of petition under Section 311 of the Cr.P.C. is not sufficient to make out change of circumstance for reconsideration of a bail application.
