The petitioner has called in question the endorsement dated 25.09.2023 issued by respondent No.3 – Deputy Director, Department of Pre-University Education, Haveri District (Annexure- D), whereby the name of the petitioner has been excluded from the final list of appointment for the post of Kannada Lecturer in respondent No.5- College, and also sought consequential directions to respondent Nos.2 to 5 to reconsider his case in terms of the selection list dated 07.02.2022 (Annexures-C and C1). 2. Learned counsel for the petitioner submits that the petitioner has rendered continuous service for several years and was duly selected by the Management. It is submitted that the impugned endorsement is arbitrary and without jurisdiction, - 4 - HC-KAR NC: 2026:KHC-D:1979 WP No. 100375 of 2025 thereby defeating the legitimate expectation of the petitioner. 3. Per contra, learned Additional Government Advocate for the respondents–State submits that the endorsement dated 25.09.2023 (Annexure-D) was not acted upon further. It is submitted that the authority could not complete the interview process due to non-availability of candidates, and that the respondent-authority does not intend to proceed further pursuant to the said endorsement. 4. The submission is recorded. 5. In view of the submission made on behalf of the respondents that the endorsement dated 25.09.2023 will not be acted upon, the relief sought for quashing the said endorsement does not survive for consideration. - 5 - HC-KAR NC: 2026:KHC-D:1979 WP No. 100375 of 2025 6. However, liberty is reserved to the respondent- authority to issue a fresh notification calling for applications to the post of Kannada Lecturer, if so required. In the event, such a notification is issued, the petitioner is at liberty to apply, and his candidature shall be considered in accordance with law. 7.
