P. Goswami, learned Addl. P.P., Assam appearing for the State respondent. 2. This petition under Section 483 of the BNSS, 2023 has been filed by the accused-petitioner, namely, Abdur Rahaman, praying for grant of bail in connection with Changsari P.S. Case No.215/2026 under Sections 305(b)/317(2)/3(5) of the BNS Act. Page No.# 2/2 3. The case arose out of a complaint dated 30.08.2026 lodged on behalf of Vinayak Logistics with the allegation that a truck loaded with 2308 cartons of dhara oil was booked from Changsari Railway Station to Jorhat. On the next day the truck was recovered at Changsari and at the time of its recovery, the driver Jahar Ali was missing. 4. Investigation was conducted and the present petitioner was arrested during the investigation. As per the grounds of arrest, he was found to be involved in the alleged illegal activities and offenses. As per the forwarding report, the goods were recovered at the instance of accused Mohiruddin and Aikur Rahman, @ Munna. 5. The learned counsel submits that the same aforementioned two persons, Mahiruddin and Munna, have been enlarged on bail by the learned court below. The investigation has revealed sufficient incriminating materials; it also reveals that the items from the truck was loaded into the vehicle of the present petitioner and taken away. It is revealed from the investigation that the driver has paid approximately Rs.2 lakhs to enable the other accused persons including the petitioners to take away the materials from the truck. 6. It is submitted by the prosecution that the only part of the stolen materials have been recovered. There is some progress in the investigation, but it is not yet completed. 7. I have also perused the bail objection submitted by the IO. 8. In the given facts and circumstances, the bail petition stands rejected and disposed of at this stage. 9. Return the case back.
