Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondents to pay interest amounts for the belatedly settled Provident Fund, Service Gratuity and Commutation amount of her husband at the rate of 6% per annum for 20 months of delayed period and make payment to her in the light of the judgment passed by this Court on 27.11.2025 in W.P.No.46394 of 2025 within the time limit that may be framed by this Court. 1/5 https://www.mhc.tn.gov.in/judis WP No.7809 of 2026 For Petitioner : Mr.N.Ishak For Respondents : Mr.A.Vinothraj Standing Counsel for R1 and R2 ORDER The writ petition has been filed to issue a mandamus to the respondents to pay interest amount for the belatedly settled Provident Fund, Service Gratuity and Commutation amount of her husband at the rate of 6% per annum for 20 months of delayed period and make payment to her in the light of the judgment passed by this Court on 27.11.2025 in W.P.No.46394 of 2025 within the time limit that may be fixed by this Court. 2. The case of the petitioner is that her husband, K.Ravichandran, joined the services of the respondents-Transport Corporation on 04.09.1990 and retired from service as a Special Grade Driver on attaining the age of superannuation on 28.02.2023. However, the terminal benefits payable to him were settled only on 01.11.2024 and no interest has been paid for the delayed period. It is further submitted that the petitioner’s husband died on 03.12.2024. Thereafter, the petitioner, being the wife of the deceased employee, submitted a representation to the respondents dated 30.01.2026, seeking payment of interest for the delayed period. The learned Standing Counsel for the respondents would fairly submit that they are willing to pay the interest at the rate of 6% per annum for the belated payment of the eligible and admissible amount. 4. Heard the learned counsel for both sides and perused the materials available on record. 5. In view of the above submission of the learned Standing Counsel, this Court deems it appropriate to direct the respondents to pay interest at the rate of 6% per annum for the belated payment of admissible terminal benefits from the date of retirement till the date of actual disbursal of the terminal benefits of the petitioner’s husband (Late K.Ravichandran), within a period of six weeks from the date of receipt of a copy of this order. 6. In the result, the writ petition is disposed of.
