ORAL ORDER
The present writ petition is filed seeking the following prayer:
“PRAYER WHEREFORE, it is prayed that this Hon’ble Court be pleased to allow this writ petition and issue a writ of Mandamus or any other appropriate writ or order or direction to; a) Direct the Respondent No. 1 to take action against the Respondent No. 6, society in pursuance of letter dated 31.01.2025 produced at Annexure-C. b) Direct the Respondent No.1 to 3 to consider the Representation dated 23.04.2025 and 15.07.2025 produced at Annexure-E and F and take action against Respondent No. 5 society as per Enquiry Report dated 07.12.2024 produced at Annexure-B. c) Pass such other order or direction, this Hon’ble Court deems fit in the circumstances of the case.”
2. It is the case of the petitioner that he is the member of respondent No.6 Society. It is submitted that respondent No.6 Society has indulged in several misappropriation and mismanagement of funds allotted to the Society under the various schemes by the State Government. The Society has failed to conduct the regular meetings, General Body meeting, Elections to the Managing Committee as prescribed under the Act and Bye-laws. In this regard, the petitioner had given a written complaint to respondent No.4 complaining the mismanagement

and misappropriation of funds. It is stated that in pursuance of petitioner’s complaint, respondent No.4 directed respondent No.5 vide order dated 17.03.2023 to inspect the records of the Society and submit detailed report with regard to the alleged complaints. Thereafter, respondent No.5 issued notice dated 21.04.2023 to respondent No.6 Society and inspected the Society and its records. It is submitted that respondent No.5 show-caused the respondent No.6 Society and petitioner to submit their written explanation. 3. It is stated that after verification of the records and obtaining information from the public, respondent No.5 submitted a report dated 27.12.2023 to respondent No.4. Respondent No.5 recommended for conducting an enquiry against respondent No.6 Society as contemplated under Section 25 and for appointment of an Administrator as provided under Section 27-A of the Karnataka Registration Act, 1960. The respondent No.4 after hearing the parties and considering the material documents of the respondent Society submitted an Enquiry Report dated 07.12.2024.
Looking at the Enquiry Report dated 07.12.2024, respondent No.3 recommended to respondent

No.1 vide letter dated 31.01.2025 to take action against respondent No.6 Society and further to appoint an Administrator as provided under Section 27-A of the Act. Now, it is grievance of the petitioner that respondent No.3 failed to take any action against respondent No.6 and he has given a representation dated 23.04.2025 to respondent No.1. It is stated that in spite of repeated requests made by the petitioner, the respondent Authorities failed to take action and the petitioner submitted a representation dated 15.07.2025 to respondent No.3 which was not considered. 4. Learned High Court Government Pleader appearing for respondent Nos.1 to 5 submits that they have already appointed an Administrator and respondent No.1 will consider the representation of the petitioner in accordance with law and will take appropriate steps insofar as the misappropriation of funds is concerned, basing on the letter dated 31.01.2025. 5. Having heard the learned counsel for the petitioner and the learned High Court Government Pleader, perused the entire material on record. Considering the fact that already an Administrator is appointed and the submission of the High Court

Government Pleader that respondent No.1 will act on the representation and the letter dated 31.01.2025, this Court is passing the following:
ORDER i. The respondent No.1 shall consider the representation dated 31.01.2025 and shall pass orders in accordance with law after giving due opportunity to all the concerned. ii. Though notice is awaited as far as respondent No.6 is concerned, the writ petition is disposed of as no adverse orders are passed against respondent No.6. iii. Accordingly, the writ petition is disposed of. iv. All I.As. in this petition shall stand closed.
